I agree with Thomas Sowell's rationale in this piece about the recent Supreme Court decision about the New Haven fire department. I just wish he would have done more explaining why ``disparate impact'' became part of civil rights law -- because for a long time tests, poll taxes and other such foolishness were designed to keep blacks from voting, getting jobs or advancing in the world. Those tactics were used to get around charges of overt racism. Maybe I'll tackle that in a column. For the record: I believe what the Supreme Court did with this case was evidence of an activist court, this time from the conservative side. And I'm glad they did because they corrected an obvious wrong.
